Anyone can prepare a will, right?
No-luck Chuck Sr was feeling a bit under the weather, so his son told him to get tested for Covid-19. Sr was a bit reluctant at first and said that he could not possibly be infected since he only goes to a handful of places weekly. A couple of days later, Jr finally convinced his father to go and get tested. The results came back positive. Fortunately, Sr was able to recuperate at home.
A few weeks after the covid-19 testing incident, Sr was still a bit scared. He did some reflecting, drafted a Will, and told his son about it. Sr had placed the Will in his nightstand drawer so nobody should have to worry if something happened to him. Jr thanked his father for being so thoughtful and took a picture of the Will, just in case is was misplaced.
The day after Sr wrote his Will, he got into a car accident on his way to the supermarket and died. After the funeral, Jr went to court and presented his father’s Will. Unfortunately, he was told that his father’s will was invalid.
There are many details to consider when drafting a Will. A knowledgeable attorney can clarify concerns and make sure the document is truly legally binding. Also remember that your wishes in a Will can change over time, so choosing the right type of legal instrument is important.
