(I) Will:

(A) A legal document that sets forth your wishes regarding the distribution of your property.

(B) Designates the person whom you want to be responsible for carrying out those wishes.

A will needs to comply with certain formalities in order to be valid.

If you die with a will, your wishes will be clear. Necessary legal process, can be lengthy and costly.


(II) Trust:

Fiduciary arrangement that allows a third party, you appoint to curate the assets for the beneficiaries.

Probate is not required to transfer ownership of these assets to individuals when you die. When you die, the trust does not die with you but rather lives on as a separate entity.

Trusts is a great way to minimize estate taxes and avoid a court probate process that you would have to undergo had you died without a will.
